In its Hobby Lobby decision, the Supreme Court interpreted the Religious Freedom Restoration Act (RFRA) as providing new religious freedom rights to closely held corporations. What makes an employer a closely held corporation? How far will this decision reach? How will the Federal and state RFRAs interact with the Title VII, ACA, NLRA and state and local human rights laws that provide broader protection than the federal laws? What impact will a "closely-held" employer's claim to religious freedom have on the rights of employees to be free from discrimination based on sexual orientation, their own religious expression, the right to receive benefits including contraceptives, to organize, etc.?
